The MUSILIB.COM website

The MUSILIB.COM website proposes royalty-free music for a professional or personal use through the online sale of the licence to use these pieces of music.

These General Terms and Conditions are designed to rule the online sales transactions of the pieces of music. These transactions are subject to the agreement of its users to these General Terms and Conditions. The users commit themselves to enjoying their legal capacity to accept the present contract and to subscribe to the offers of this website.
During their purchase order of a music file, members are requested to consult and ratify these.
General Terms and Conditions by ticking the corresponding box. In the absence of this ratification, the purchase order shall not be accepted.

Once the order is validated, a licence to use will be attached to the delivery of the audio files, describing the buyer's rights. Musilib holds the exploitation rights of the music offered for sale on this website. These pieces of music have not been legally submitted to author's societies, composers and editors of music, but are licensed under an adapted Creative Commons Licence with authorisations laid down in these General Terms and Conditions and in the licences provided with the order confirmation.
Musilib does not grant the customer any form of exclusivity on the pieces of music purchased on this website or their attached rights.

Prices & Delivery

Musilib sets the price of the pieces of music offered on the website. Prices are shown and include the access and downloading of the files as well as the delivery of a licence to use.
The customer pays the amount of the order by secure online bank card payment. The payment by cheque is possible though the order processing will be longer.
Following their order, customers shall receive an e-mail confirming their purchase, including one or several link(s) in order to download the purchased pieces of music, and the licence to use. This e-mail is worth acceptance of the order and becomes the sales contract between Musilib and the customer.

GUARANTEE

All music files created by Musilib have been carefully examined during their design. However, in cases of malfunction or damage, the customer can request the replacement of the file within 8 (eight) days from the date of delivery of the product. This request must be sent by e-mail or mail to the address of the producing company.

LICENCE

You will find your licence in the e-mail confirming your order for purchased pieces of music. The licence is nominative. It is worth voucher for collecting societies and no other royalty will be payable.

Your rights:

All our music is exclusively licensed under this licence for the purpose of clarity and ease of use. Whatever the nature of your project, the media type or the broadcast medium, you can make use of our music at your convenience, with almost no limit in time (70 years). You can integrate and broadcast our music in your productions. You can make use of our music on behalf of a third party as long as this third party has no access to the pieces of music.

Restrictions:

The pieces of music remain the property of MusiLib. The user has no ownership rights on the music available on this website. He enjoys a licence to use that is granted by the present license agreement, compliant with French and international laws. Therefore, you may not rent, sell, share or otherwise trade the files as such, sublicense our music or claim their creation. Each licence is assigned to a single project.

Our commitments

We guarantee the good quality of our music and will replace any defective file within 8 days from the delivery of the file.
Our music is out of copyright. It is licensed under a Creative Commons licence restricting the possibilities of use of the pieces of music. However, once you have paid the single price of 39€ for one piece of music, you will receive a nominative complementary licence, cancelling these restrictions of use and allowing you to exploit our music for commercial gain.

This licence is worth voucher for collecting societies and no other royalty will be payable.

 
Our commitmentsS

The customers of MusiLib commit to respect the present General Terms and Conditions.
Any misconduct may result in sanctions up to the deletion of the customer's account, and this without the customer being able to request any compensation or refund.

EXEMPTION FROM RESPONSIBILITIES

The customer commits to submitting a valid e-mail address on subscribing. Certain Anti-spam software blocks reception of e-mails. In the event that a protection program and/or the e-mail software would prevent the receiving of the confirmation e-mail sent by MusiLib, no claim can be formulated against MusiLib.

MusiLib is not liable for damages caused to the customer because of the receiving and use of audio files.
The present website may contain hypertext links to other sites. MusiLib has no control over the content of such websites and cannot guarantee the reliability or accuracy of any information thereon, or any damages that may result from your use of these sites.
MusiLib provides the customers with a client service via the contact form or the e-mail address contact@musilib.com. MusiLib will reply as soon as possible.

INFORMATION RELATED TO THE ACT N°78-17 OF 6 JANUARY 1978 ON DATA PROCESSING, DATA FILES AND INDIVIDUAL LIBERTIES

Customers' contact information is stored in the website when they register. The customers give their consent to using this nominative data on the basis of their order. In accordance with the act n°78-17 of 6 January 1978 on data processing, data files and individual liberties, customers have at any time the right to access, modify, amend and / or delete the mentioned personal data.
MusiLib is committed to respecting the personal privacy of individuals who visit its web site and the collected data may not be used for any purpose other than the improvement of the website and of the service provided.

Personal data will not be forwarded to third parties without express consent of the customers. The information provided may only be transferred for legal and/or judicial reasons upon request of the authorities authorised to request such a transfer.
In the event that the data contained in the customer's account would disappear as a result of a fortuitous event, technical breakdown or force majeure, the site or its editor shall not be responsible.
When creating a user account, the user is prompted to choose a password. This password is privacy guarantee of the data contained in the customer account. The editor shall not be responsible for any unauthorized access to a customer account.

INTELLECTUAL PROPERTY RIGHTS ON THE INFORMATION ON MUSILIB.COM

All the intellectual property rights (especially the rights on the texts, pictures, layout, graphics, structure, audio elements) are owned by the editor of the present website, its ordering persons and/or advertisers, without any limitation. Any infringement on the intellectual property right of said individuals may give rise to legal proceedings.

MISCELLANEOUS PROVISIONS

The present conditions are governed by the French law. They may be amended at any time by MusiLib. For the customer, the valid conditions are those enforced on the site on the date the order is placed.
The parties agree that for any disagreement which may occur, the Tribunal de COMMERCE de LA ROCHE SUR YON shall have jurisdiction.
